Section 106 Mitigation

If a historic property is directly or indirectly impacted by an ARDOT project, then mitigation occurs in the form of Phase III archeological data recovery, architectural documentation, and/or possible options determined through consultation.

Section 106 mitigation efforts varies based on a number of factors, including:

  • the historic property type (archeological sites versus historic structures),
  • the consulting parties involved (State Historic Preservation Officer, Tribes, interested parties, or the public, as applicable),
  • the scale and nature of the project, and
  • the impacts of the project on the historic property.

Mitigation serves to resolve adverse effects to a historic property and fulfill FHWA and ARDOT’s requirements under Section 106.
